This guide to Bills of Lading looks at the problems and practical issues common to their everyday use. It explains how to avoid disputes and challenges arising from improper usage and contains both practical guidance and theory selection that shows the legal foundations of the advice given.

The text also includes copies of relevant international conventions, an annotated copy of the BIMCO Congenbill and the latest set of recommended standard letters.

The fourth edition has been updated to reflect the useful confirmation from the courts in The Elin that deck cargo clauses can be effective to allow a carrier to contract out of liability for carriage of deck cargo.

It is now 25 years since The North of England P&I Association published the first edition of this guide, with the last edition produced in 2014. Since that last edition, North has merged with Standard Club to form NorthStandard and Stephen Mills has left North as a consultant to focus on his practice as a maritime mediator. This fourth edition gains a new author: David Richards, the Deputy Global Head of P&I Claims at NorthStandard and its Head of Legal & Expertise.

There have been a number of developments in the field of bills of lading in the last nine years, most significantly the introduction of the Electronic Trade Documents Act to English law which will allow, in the right circumstances, electronic bills of lading to replicate all the legal functions of the traditional paper bill of lading. The section on Electronic Bills of Lading in this guide has been heavily expanded and revised.

There have also been developments in the field of misdelivery claims, with courts throughout the world recognising that banks should not make such claims against carriers when they are fully aware that cargo was not being delivered against production of an original bill of lading.

Furthermore, there have been decisions from the courts on another bane for shipowners and clubs: deviations. Whilst the lower courts have confirmed the serious legal consequences of an unjustified deviation, there has also been helpful clarification of what is meant by the direct or customary route.

This edition also reflects the useful confirmation from the courts in The Elin that deck cargo clauses can be effective to allow a carrier to contract out of liability for carriage of deck cargo. More disappointingly for shipowners is the strict approach taken by the courts in The Tai Prize to the question of who has the duty to accurately describe the apparent order and condition of cargo in a bill of lading.
Everyone operating in the shipping industry will have felt the increase in the use of trade sanctions and the section of this guide dealing with sanctions has been revised accordingly.

As with previous editions, this is not a legal textbook designed primarily for lawyers but is designed to be a practical guide for those on the front line, supported by more detailed notes on the underlying legal theory to underpin the practical guidance. Where this guide refers to publications and circulars produced by The North of England P&I Association before its merger with Standard Club in February 2023, it refers to the antecedent club as ?North?.
